Welcome to the Eliason, et al. v. Gentek Building Products, Inc., and Associated Materials, Inc. Settlement Website

This website concerns a lawsuit involving certain steel siding manufactured by Gentek Building Products Inc. and Associated Building Materials ("Defendants" or "Gentek").

A settlement has been reached in this lawsuit. With certain exceptions described in the Notice which you may download on this website, you may be entitled to participate if you are a member of the Settlement Class, which includes all persons, organizations, municipalities, corporations and entities that own structures, whether commercial or residential, on which Gentek Steel Siding was applied during the period January 1, 1991 through March 15, 2013, that is covered by a Gentek Steel Siding warranty and which siding experienced Steel Peel.

The Settlement will provide for enhanced warranty procedures and remedies for Class Members, described in the Long Form Notice on the Case Documents page.

You must submit a valid proof of purchase (described in the Notice) and Gentek's Self-Inspection Report, and must establish that your siding has experienced Steel Peel, in order to receive benefits under the Settlement Agreement.

The Court in charge of this case has not yet decided whether or not to approve the Settlement. The enhanced warranty procedures and superior remedies provided for by the Settlement will not be implemented until after the Court approves the Settlement and after any possible appeals are resolved. If the Settlement becomes effective and if you are a Class Member whose Siding is experiencing Steel Peel, you will be entitled to the benefits of the Settlement at that time. If the settlement is approved, this website will provide updated information regarding how to make a claim under the settlement. Check back beginning August 2, 2013. The procedure for initiating a claim under the Settlement will not take effect until the Settlement becomes effective.

Update to dates for motion for attorneys' fees and opposition thereto on Long Form Notice:

Motion by plaintiffs' counsel for an award of attorneys' fees and reimbursement of costs to be filed no later than June 28, 2013

Opposition by plaintiffs' counsel for an award of attorneys' fees and reimbursement of costs to be filed no later than July 15, 2013
